Prospective tenants may submit application fee(s) and a holding deposit equal to one month's rent through PayPal. If submitted in this manner, the application must be received at our office via either fax, mail, or in person. We will not process an application without receiving payment of the application fee. We will not hold apartment for anyone without a deposit equal to one month's rent, as well as submission of the application(s) and corresponding fee(s).

As a courtesy to our prospective tenants, Port Property Management, Inc. has contracted with PayPal to enable prospective tenants to pay for their rental application fees and/or rental deposit monies via the Internet. Prospective tenants who utilize the PayPal system in such a manner hereby agree to indemnify and hold Port Property Management, Inc. harmless of and from any and all damages arising from the use of PayPal, and agree to look solely to PayPal for satisfaction of the same. PayPal may be contacted in the following manner:

RENTAL APPLICATION FEES : Fees may be paid via services provided by PayPal. THE RENTAL APPLICATION FEE IS NON-REFUNDABLE.

RENTAL DEPOSIT : Rental holding deposits may be paid via services provided by PayPal. SAID RENTAL HOLDING DEPOSIT IS NONREFUNDABLE, UNLESS THE PROSPECTIVE TENANT IS DENIED TENANCY, OR THE PROSPECTIVE TENANT INFORMS PORT PROPERTY MANAGEMENT, INC. OF THE INTENTION TO WITHDRAW THE RENTAL APPLICATION WITHIN FORTY EIGHT (48) HOURS OF THE RENTAL APPLICATION HAVING BEEN APPROVED. IN THE EVENT THAT THE RENTAL HOLDING DEPOSIT IS RETURNED AS OUTLINED ABOVE, THOSE PROSPECTIVE TENANTS WILL ALSO BE RESPONSIBLE FOR PAYMENT OF PAYPAL'S TRANSACTION FEES, SAID TRANSACTION FEE BEING A PERCENTAGE OF THE TOTAL TRANSACTION AMOUNT AS DETERMINED BY PAYPAL. THUS, THE RENTAL HOLDING DEPOSIT WILL BE RETURNED LESS PAYPAL'S TRANSACTION FEES.

NO OTHER USE : The PayPal system is not available to prospective tenants for any other use connected to the business of Port Property Management, Inc., aside from the uses specifically set forth above.

DISCLAIMER OF WARRANTIES : PORT PROPERTY MANAGEMENT, INC. GIVES NO WARRANTY, EXPRESS OR IMPLIED, AS TO DESCRIPTION, QUALITY, MERCHANTABILITY, FITNESS FOR ANY PARTICULAR PURPOSE, PRODUCTIVENESS, OR ANY OTHER MATTER, OF ANY GOODS OR SERVICES WHICH ARE PROVIDED INCIDENT TO THE PAYPAL SYSTEM. PORT PROPERTY MANAGEMENT, INC. SHALL BE IN NO WAY RESPONSIBLE FOR THE PROPER USE AND SERVICE OF THE PAYPAL SYSTEM, AND THE PROSPECTIVE TENANT BY MAKING USE OF THE PAYPAL SYSTEM HEREBY WAIVES ALL RIGHTS AS AGAINST PORT PROPERTY MANAGEMENT, INC. RELEVANT TO SAID USE.

DISCLAIMER OF EXPRESS WARRANTIES : Any affirmation of fact or promise made by Port Property Management, Inc. related to the PayPal system shall not be deemed to create an express warranty that the goods or services shall conform to the affirmation or promise; any description of the goods or services is for the sole purpose of identifying them and shall not be deemed to create an express warranty that the goods or services shall conform to such description; any sample or model PayPal transaction, illustration or description is for illustrative purposes only and shall not be deemed to create an express warranty that the goods or services shall conform to the sample or model; and no affirmation or promise, or description, or sample or model shall be deemed part of the basis of the bargain.

DISCLAIMER OF IMPLIED WARRANTIES : PROSPECTIVE TENANT'S PAYPAL TRANSACTIONS ARE MADE ON THE EXPRESS UNDERSTANDING THAT THERE IS NO IMPLIED WARRANTY BY PORT PROPERTY MANAGEMENT, INC. THAT THE GOODS OR SERVICES SHALL BE MERCHANTABLE OR AN IMPLIED WARRANTY THAT THE GOODS OR SERVICES SHALL BE FIT FOR ANY PARTICULAR PURPOSE. THE PROSPECTIVE TENANT ACKNOWLEDGES THAT HE IS NOT RELYING ON PORT PROPERTY MANAGEMENT, INC.'S SKILL OR JUDGMENT TO SELECT OR FURNISH GOODS OR SERVICES SUITABLE FOR ANY PARTICULAR PURPOSE AND THAT THERE ARE NO WARRANTIES WHICH EXTEND BEYOND THE DESCRIPTION ON THE FACE HEREOF.

DISCLAIMER OF WARRANTIES, CONSEQUENTIAL DAMAGES : THE WARRANTY PROVIDED IN THIS ARTICLE AND THE OBLIGATIONS AND LIABILITIES OF PORT PROPERTY MANAGEMENT, INC. THEREUNDER ARE EXCLUSIVE AND IN LIEU OF AND PROSPECTIVE TENANT BY MAKING USE OF THE PAYPAL SYSTEM HEREBY WAIVES ALL OTHER REMEDIES, WARRANTIES, GUARANTIES OR LIABILITIES, EXPRESS OR IMPLIED, ARISING BY LAW OR OTHERWISE (INCLUDING WITHOUT LIMITATION ANY OBLIGATIONS OF PORT PROPERTY MANAGEMENT, INC. WITH RESPECT TO FITNESS, MERCHANTABILITY AND CONSEQUENTIAL DAMAGES) OR WHETHER OR NOT OCCASIONED BY PORT PROPERTY MANAGEMENT'S NEGLIGENCE. THIS WARRANTY SHALL NOT BE EXTENDED, ALTERED OR VARIED EXCEPT BY A WRITTEN INSTRUMENT SIGNED BY PORT PROPERTY MANAGEMENT, INC. AND PROSPECTIVE TENANT.
